Next Юраш і.і. особливість укладення мирової угоди в цивільному процесі на українських землях в польсько-литовські та козацькі часи (хiv-хviii ст.). у даній статті автор досліджує становлення та розвиток інституту мирової угоди в цивільному процесі на прикладах польських, литовських та козацьких правових пам’яток і аналізу судових справ. робиться висновок, що законодавче за- кріплення інституту мирової угоди вперше відбу- вається в польсько-литовські часи та наводяться випадки з судової практики кін. хіv ст., де сторо- ни завершують розгляд майнового спору прими- ренням та домовленістю між собою. аналізується польсько-литовське та козацьке законодавство, зокрема, віслицький статут, литовські статути, права, за якими судиться малоросійський народ і т.д., яке визначає умови та процедуру укладен- ня мирової угоди в цивільному процесі, а також застереження щодо реалізації даного права. від- значається спадковість правових традицій поль- сько-литовського періоду в козацькі часи через існування схожої процедури укладення мирової угоди в суді. з іншого боку, звертається увага на існування більш досконалих законодавчих форм щодо процедури укладення мирової угоди в ко- зацькому законодавстві хvііі ст., зокрема, перед- бачення випадків, коли суд не може затвердити мирову угоду сторін цивільної справи. окремо автором аналізується особливість укладення мирової угоди в недержавних судах, таких як полюбовний суд та копний суд. якщо укладення мирової угоди в полюбовному суді рег- ламентується законодавчо, то в копному – на під- ставі норм звичаєвого права. звертається увага на таке обмеження в реалізації сторонами права на укладення мирової угоди в копному суді як наявність згоди общини на такі процесуальні дії. припускається, що подібна практика могла бути зумовлена несенням колективної відповідальності общини за дії її членів. відзначається існування однакового правового наслідку в досліджувані періоди в разі зловживання правом на укладення мирової угоди: сплата грошового штрафу суддям у випадку повторного звернення особи до суду при наявності укладеної мирової угоди. ключові слова: цивільний процес, мирова угода, еволюція, польське право, литовське пра- во, козацьке право. yurash i.i. peculiarity of concluding an amicable agreement in civil proceedings on ukrainian lands in polish-lithuanian and cossack times (xiv-xviii centuries). in this article, the author examines the formation and development of the institution of amicable settlement in civil proceedings on the examples of polish, lithuanian and cossack legal monuments and analysis of court cases. it is concluded that the legislative consolidation of the institution of amicable settlement occurs for the first time in polish-lithuanian times and there are cases from the case law of the end. xiv century, where the parties complete the consideration of the property dispute by conciliation and agreement between them. polish-lithuanian and cossack legislation is analyzed, in particular, the vistula statute, lithuanian statutes, the rights of the little russian people, etc., which determines the conditions and procedure for concluding an amicable agreement in civil proceedings, as well as reservations on the exercise of this right. the hereditary legal traditions of the polish-lithuanian period in cossack times are noted due to the existence of a similar procedure for concluding an amicable agreement in court. on the other hand, attention is drawn to the existence of more advanced legislative forms on the procedure for concluding an amicable agreement in the cossack legislation of the eighteenth century, in particular, anticipation of cases where the court can not approve the amicable agreement of civil parties. separately, the author analyzes the peculiarities of concluding an amicable agreement in non-state courts, such as the amicable court and the mining court. if the conclusion of an amicable agreement in an amicable court is regulated by law, in the mainland – on the basis of customary law. attention is drawn to such a restriction in the exercise by the parties of the right to conclude an amicable agreement in the mining court as the presence of the consent of the community to such procedural actions. it is assumed that such a practice could be
